In court documents obtained by PEOPLE, Sandoval is denying his ex’s request for "partition"

Tom Sandoval is responding to his ex-girlfriend Ariana Madix’s lawsuit that requested the pair sell the L.A. home they still share.

In court documents filed on Friday and obtained by PEOPLE, Sandoval, 40, alleges that Madix “fails to state sufficient facts to state a cause of action” against him and thus he feels a partition of their shared home should not be granted.

According to the filing, Sandoval also claims that Madix, 38, has “failed to mitigate whatever damages” she claims to have suffered and that she did not act “reasonably and in good faith” when filing the lawsuit against him.

If partition of the home is granted, Sandoval argues that he should “receive an accounting and compensatory adjustments” for the repairs and improvements he made to the home, including changes “that enhance the value,” per the document.

Ultimately, Sandoval disagrees with Madix’s request for a "partition by sale" which would result in the proceeds being evenly split between her and Sandoval, as stated in her January lawsuit.

According to the documents, the reality star was hoping to avoid a "division in kind" that could result in both of them retaining ownership of the property as one party could then potentially sell their portion to a third party.

The Vanderpump Rules costars purchased the newly completed, 4,334-square-foot home in the Valley Village neighborhood in 2019 for $2.075 million, according to property records obtained by PEOPLE.

"We looked at fixer-uppers but we also looked at [turnkey] places and given the timing of when we moved and how busy [we are] . . . I am so glad that we chose where we chose and we didn't have to do anything other than the fun stuff," Madix told PEOPLE in 2021 of their house-hunting experience.

"We would have been screwed, honestly. I'm thrilled at how we chose to do things and everything really worked out for the best," she added.

After nine years together, they officially called it quits in March 2023 when Madix learned Sandoval was cheating on her with Leviss.

Following their split, a representative for Sandoval revealed to PEOPLE that the exes were still living together in the home and that the situation was complicated.

"They own the house together, and what happens next with the property will take time to sort out," the rep said. "This isn't something that's going to be decided in a weekend."
