Sophie Turner Steps Out for Dinner in N.Y.C. with a Friend amid Custody Battle with Joe Jonas

The 'Game of Thrones' alum previously alleged that Joe Jonas was preventing their daughters from returning to England by withholding their passports

Sophie Turner was spotted out in New York City amid her split from husband Joe Jonas.

The Game of Thrones alum arrived for dinner with a friend at Hotel Barrière Fouquet's New York on Thursday.

That same day, Turner, 27, filed a lawsuit in a Manhattan court claiming she learned of Jonas’ divorce filing “through the media.”

In documents obtained by PEOPLE, the “Only Human” singer filed for divorce on Sept. 5 after claiming that "the marriage between the parties is irretrievably broken."

Earlier on Thursday, Turner sued Jonas, 34, for alleged wrongful retention of the couple's two kids: Willa, 3, and a daughter, identified in previous court docs as D., 14 months.

The complaint, which was obtained by PEOPLE, alleges Jonas is withholding their children’s passports which is preventing the girls from being reunited with the actress.

"On September 19, 2023, the Father's Florida attorney confirmed that the Father will not return the passports to the Mother and will not consent for the children to return home to England," the documents claim.

"Based on the Father's express statements that he will not return the children to England and will not return the children's passports to the Mother, on September 20, 2023, the Mother has submitted her Hague Convention Application for Return to the Central Authority for England & Wales seeking the return of the children to England."

Jonas responded to her claims, referring to them as being “misleading.”

A rep for the Disney alum said in a statement obtained by PEOPLE: “After multiple conversations with Sophie, Joe initiated divorce proceedings in Florida, as Florida is the appropriate jurisdiction for the case. Sophie was aware that Joe was going to file for divorce. The Florida Court has already entered an order that restricts both parents from relocating the children. Sophie was served with this order on September 6, 2023, more than two weeks ago."

The statement claimed that both parents “had a cordial meeting this past Sunday in New York, when Sophie came to New York to be with the kids,” and that Jonas believed “they had reached an understanding that they would work together towards an amicable co-parenting setup."

According to the representative, less than 24 hours after the terms were agreed upon, "Sophie advised that she wanted to take the children permanently to the UK. ... If he complies, Joe will be in violation of the Florida Court order."

“This is an unfortunate legal disagreement about a marriage that is sadly ending. When language like 'abduction' is used, it is misleading at best, and a serious abuse of the legal system at worst. The children were not abducted," the statement added, in part.

"It's going to be a very thorny case," Marilyn Chinitz, a matrimonial partner at Blank Rome LLP, told PEOPLE. The legal expert, who is not involved in the case, noted that their lifestyle could complicate a court being able to establish the children’s “home state.”

Amid the divorce and custody case, the X-Men: Apocalypse actress was also seen spending time in New York with Jonas’ ex, Taylor Swift, this week.

"They were normal. Completely normal," a source told PEOPLE of Swift, 33, and Turner having dinner together just two days before Turner filed for custody. "Everyone was all excited, but they were normal."

While Turner was out to dinner, Joe Jonas was performing with his band, the Jonas Brothers, in Philadelphia, Pennsylvania.

The crowd at the Wells Fargo Center cheered extra loud when the trio sang 2018’s “Hesitate,” a song Joe wrote about Turner that he considered his vows to her. Joe did not speak at all before or after the song's performance.
