Ruby Franke's Husband Tried To Have Daughter Arrested on Burglary Charge After Police Searched Home: Report

Kevin Franke, the husband of Ruby Franke, allegedly wanted to have his estranged daughter arrested on a burglary charge after police broke into his home to serve a warrant, according to a FOX News report that was subsequently confirmed to PEOPLE by Kevin’s attorney.

Ruby Franke is a disgraced former YouTube parenting vlogger, who along with her podcast partner Jodi Hildebrandt, was charged with six counts of felony child abuse. Two of Franke’s children were rescued from Hildebrandt’s home after being found emaciated and showing signs of malnourishment, PEOPLE previously reported.

Police subsequently searched Franke’s home in Springville, Utah. Kevin filed a police report after he discovered his house had been broken into, telling an officer that electronics had been stolen — and that he suspected that his oldest daughter, Shari, was responsible, according to an incident report obtained by FOX News.

"Kevin stated that Shari is not allowed in the home, and that he believes she entered unlawfully and he wants her charged with burglary," police reportedly wrote in the incident report.

Springville police then told Kevin that police had executed a search warrant, and that his daughter was not responsible for the damage, the outlet reported. The officer also reportedly told Kevin that Shari was unaware that she was not allowed to take the electronics out of the home, and they were returned. The electronics, FOX reported, citing the incident report, were three tablets, three cell phones, three cameras, written journals and three passports.

PEOPLE requested a copy of the incident report from the Springville Police Department, which was not immediately made available.

Shari Franke was estranged from both Ruby and Kevin and had called police in September 2022 requesting a welfare check at the family home. Shari has been vocal after her mother's arrest, moving to gather internet clips that show alleged abuse by her mother. Posting to Instagram Stories after her Ruby's arrest, Shari shared a snap of the officers outside the family’s house, writing, “Finally.”

When asked about the police report involving Shari, Kevin Franke’s attorney Randy Kester sent PEOPLE a statement.

“At the time, Kevin was understandably upset that his front door had been broken, and that much of his property had been taken, including personal property as well as  private and personal electronic devices and their contents,” Kester tells PEOPLE. “It was his home and property and he was never served with a warrant.  Moreover, this allowed other third parties, who did not live at the home, access to his home and property, and of which they took advantage.”

“Notwithstanding, what he considered to be a significant and hurtful violation of the sanctity of his home and property, Kevin has taken an ameliorating and healing path,” the statement continues. “He has taken no action adverse to the police and continues to strengthen the bonds between he and all of his children.”

Ruby Franke, 41, and Hildebrandt, 54, are both currently being held without bail after a September hearing was delayed.

The two podcasting partners have been held separately since their arrest at Hildebrandt’s home in Ivins, Utah.

The women were arrested after Ruby’s 12-year-old son allegedly escaped Hildebrandt’s house and ran to a neighbor asking for food and water, according to the Santa Clara-Ivins Public Safety Department.

Police allegedly also found Ruby’s 10-year-old daughter in similar condition.

Kevin has been questioned but has not been charged with a crime.
