A 2021 sexual battery lawsuit filed by Alexa Nikolas against her ex-husband, Rhye’s Mike Milosh, was quietly dropped last May, and now Milosh is suing Nikolas’ attorneys for “malicious prosecution.” In a new suit filed August 30th, Milosh argues that Nikolas’ legal team knew their lawsuit wouldn’t hold up in court. The singer is now seeking over $10 million in “actual damages” done to his career, and asks that further “punitive damages [be] established at trial.”

As the new lawsuit alleges, the sexual battery suit slowed down during the pre-trial discovery phase, when Nikolas and her attorneys purportedly did not respond to requests for evidence to back up their claims.

According to court documents viewed by Consequence, Nikolas’ lawyers filed to drop the lawsuit on May 23rd. As part of the dismissal, Nikolas, a former child star best known for Zoey 101, also agreed to pay Milosh’s legal fees. A Memorandum of Costs served to Nikolas’ lawyers demanded $2,240.98, though sources close to Milosh say a settlement was reached for a slightly lower amount.

Nikolas publicly accused Milosh of sexual misconduct, physical abuse, and financial manipulation in an open letter on Instagram titled “Groomed by the Groom.” She claimed that she initiated contact with him when she was 16 years old after taking LSD, and that he maintained a flirtatious relationship with her, asking her to undress on multiple occasions. After her 18th birthday, when he was about 35 years old, she said that he flew her to Germany and raped her.

“I did not respect my no and neither did he,” she said. Her lawsuit alleged that he “digitally began penetrating [her] in her anus.” She sought unspecified damages.

Milosh argues that Nikolas’ lawyers knew the case was frivolous. His attorneys cite the lack of evidence presented during the discovery phase, as well as an agreement Nikolas made not to sue Milosh during their divorce settlement, referred to as a “Stipulated Judgment and Divorce Decree.”

According to Milosh’s lawyers, “In that Judgment, among other things, Ms. Nikolas waived any and all claims against Mr. Milosh, confirming that she was not the victim of any sort of assault or abuse and that she did not have any claims to assert against him.”

The new suit claims that Nikolas’ sexual battery lawsuit would have been thrown out because of the Stipulated Judgment and Divorce Decree, and argues that her attorneys “filed the lawsuit knowing that Ms. Nikolas did not have a legal leg to stand on and actively hid material facts from the Court in violation of their ethical obligations.”

Milosh is seeking “well over” $10 million from the firms Gibbs Law LLP, Greenberg Gross LLP, and several individual attorneys.

In a statement to Consequence, Nikolas wrote, “I will be refilling my case.”

Malicious prosecution lawsuits are an increasingly common tactic for artists who believe they’ve been targeted for spurious litigation. Earlier this month, Bob Dylan called for “monetary sanctions” against the attorneys who represented a sexual assault accuser who dropped her lawsuit after historians called into question her timeline.
