Prosecutors Call R. Kelly A Liar Over His Solitary Confinement Claims
The prosecutors going after R. Kelly say the singer’s his claims of being mistreated while in ‘solitary confinement’ are lies, pointing to him having multiple cell mates.
According to court documents obtained by The Blast, the government is responding to Kelly’s recent plea to get out of solitary confinement and demanded he not be allowed out on bond.
The prosecutors write, “Suffice it to say that defendant is not in solitary confinement, as he has had a cellmate for quite some time despite his initial refusal. In fact, he has had more than one cellmate so far. In any event, these are not reasons to disrupt the Court’s prior ruling to detain defendant.”
Prosecutors even attached an incident report from prison dated July 18. On the day, Kelly was written up for refusing to obey an order.
An officer had told Kelly to take a cellmate but he refused. He told them he didn’t have to take a “cellie” and that he had “too much going to worry” about an incident report being written.
The officer noted, “I advised him what was going to happen if he refused and he stated he understood.” As a result, Kelly had his email access suspended for 30 days.
The report noted, “Inmate Kelly displayed a poor attitude throughout this investigation.”
Recently, Kelly pleaded with the judge to help him get out of solitary confinement.
He wants the judge to order the Federal Bureau of Prisons immediately release him into a less-restrictive unit. The motion says the prison claims Kelly is housed in solitary for safety reasons.
His lawyer says in the motion, “Instead of placing the Mr. Kelly one of several other floors available as an alternative to general population, the BOP has placed Mr. Kelly where inmates go to be punished, on the facility’s most restrictive floor, with zero privileges. In essence, even though he has not violated a single BOP rule, Mr. Kelly is being unconstitutionally punished and segregated from the rest of the prison population.
His lawyer says in Kelly’s unit there is “no meaningful interaction with other humans”, “no time outside getting sunlight” along with not being allowed to buy snacks and candy.Kelly also takes issue with not being allowed a television. The disgraced singer also wants more shower access. He currently only gets three days per week.
He is only allowed one 15-minute phone call per month, instead of the 300 minutes other inmates are allowed. Kelly also argues the restrictions make it hard for him to prepare for his defense. He claims the prison makes him be handcuffed and remain handcuffed during meetings with lawyers.
The motion adds, “Mr. Kelly has extremely limited literacy, which means that every piece of discovery is going to have to be read to him, and order to review. When meeting with Mr. Kelly anything and everything the Council wishes to review with him must be kept on counsel’s lap or the floor, because there is no table. Given that Mr. Kelly is cuffed during these visits, and there is no table, it is impossible for counsel to review documents with him and write notes.”
A judge has yet to rule.
Kelly recently plead not guilty to 18 federal charges relating to charges of child pornography and obstruction of justice. He has been stuck behind bars after a judge denied him bond.
Kelly has been locked up in Chicago’s downtown Metropolitan Correctional Center after he was arrested by Homeland Security agents and NYPD detectives.
The R&B star is facing a maximum prison sentence of 195 years in Chicago for alleged crimes against 10 different victims.
His lawyer has been trying to get him out on bond but has not been successful.
He argued Kelly was not a flight risk and promised his client would not talk to young girls while out. He also promised to wear a GPS monitoring device.
The judge wasn’t swayed.
