On June 7, 2017, President Trump nominated McFadden to serve as a United States District Judge of the United States District Court for the District of Columbia, to the seat vacated by Judge Richard J. Leon, who took senior status on December 31, 2016. On October 30, 2017, the United States Senate under the direction of Mitch McConnell voted 84–10 in favor of his confirmation. He received his judicial commission on October 31, 2017. And now he questions Trump.
