Olivia Wilde and Jason Sudeikis have cleared the way for amicable co-parenting after settling their child custody battle for son Otis, 9, and daughter Daisy, 6. However, they still have a legal fight ahead of them and they are a united front in this case.

Wilde and Sudeikis’ former nanny, Ericka Genaro, sued them earlier this year for wrongful termination after allegedly developing anxiety and depression while working for them. She was employed by the two actors during a tumultuous time in their relationship where Genaro alleged that Wilde “abruptly left” her, Sudeikis, and the two kids in 2020. The Ted Lasso star also reportedly vented about the split to her at all hours of the night and she “felt compelled to engage in” those conversations because of the power structure.

Genaro and her lawyers were hoping to get their day in court to confront Wilde and Sudeikis with the claims, but the judge ruled “to move this case into private arbitration,” according to a statement provided to Us Weekly by Genaro’s lawyer, Ron Zambrano. They want a jury trial, but they are accusing the judge of giving the former couple “special treatment merely because they are celebrities.” Zambrano believes they “should have to face their accuser in court” and that’s why they have filed an appeal.

Wilde and Sudeikis publicly feuded over child custody (side-eyeing Sudeikis for serving his ex-girlfriend while she was onstage at CinemaCon), but the one thing that seemed to bring them together was Genaro’s lawsuit. They’ve continually shown support for each other in the case, and it might have been the catalyst for finally negotiating a child custody settlement. Genaro was obviously there in the household during a very challenging time, and that’s why she probably wants to have her case determined by a jury.
