“Modern Family” star Sofia Vergara is accusing her ex Nick Loeb of playing dirty games in their never-ending court battle over frozen embryos.
According to court documents obtained by The Blast, Vergara is asking a judge to step in to help wrap up her legal battle.
Vergara and Loeb have been fighting in court for years over frozen embryos. They ended their relationship before having kids. Following their split, Loeb filed multiple lawsuits against Vergara trying to bring the embryos to life. Vergara has pointed to a contract they signed over the embryos, which requires both parties to consent.
The actress recently scored a huge victory with Loeb’s last lawsuit against her being dismissed. She is still battling Loeb in the lawsuit she brought against him and The ART Reproductive Center, where the embryos are stored.
In newly filed court documents, Vergara accuses the ART Reproductive Center of refusing to turn over key documents she requested. She claims to need the documents before the case can move forward.
Loeb allegedly refuses to sign a waiver allowing ART to hand over the documents to Vergara, which is stalling her case. Vergara has had enough of waiting and wants a judge to order ART to hand over the documents ASAP.
The actress also wants ART to pay $15,175 in sanctions for dragging their feet. A judge has yet to rule.
Earlier this month, Vergara scored a huge victory in a separate lawsuit filed by Loeb in Louisiana.
A judge sided with the actress and threw out all claims against her. The court ruled Loeb’s arguments over the embryos were not valid.
The court order read, “Since the pre-embryos in this case are not and never were in a Louisiana facility, Louisiana’s Human Embryo Statue does not apply to them, and they cannot be considered proper party plaintiffs in this case.”
The judge then ripped Loeb for bringing the case in Louisiana Loeb had claimed in court that he lived in the state and maintained a home. The judge took issue with Loeb’s deposition where he testified, he only spent a couple nights here and there in the state.
The court order said Loeb had virtually no connection to the state and had not voted, operated a business or held a bank account. The order pointed to Loeb even admitting he obtained a residence to bring the lawsuit. He also revealed he had a daughter by his current girlfriend, who both live in Spain.
The judge even denied Loeb’s motion to seal court records. He wrote, “What information has not been redacted is evidence that Mr. Loeb should have expected to be made public when he brought this lawsuit. Much of it is information that Mr. Loeb himself has disseminated to the media.”
The case being dismissed left only one lawsuit over the situation. The remaining case was filed in Los Angeles by Vergara against Loeb. The court battles have been nasty with Vergara accusing Loeb of fraud.
Loeb and Vergara dated for several years but split in 2014. Vergara has refused to give him consent over the embryos and the two have been battling in court ever since.
Following their split, Vergara went on to marry Joe Manganiello.
