Mischa Barton Fights to Keep Mention of Past Drug Use Out of U-Haul Crash Lawsuit

Mischa Barton is headed to trial over her infamous U-Haul crash and she wants to make sure the building she crashed into is not allowed to bring up any past issues with drugs or alcohol.

According to court documents obtained by The Blast, Barton says that the Park Wellington condos “should not be permitted to accuse defendant of having taken drugs or alcohol the night of incident where there is no evidence to support this.”

She says there is no evidence she was under the influence at the time of the incident and says the traffic collision report taken that day “clearly states” she had not been drinking. Barton also says the report does not mention “the presence or suspicion of drugs or other intoxicants.”

Barton is under the belief that Park Wellington will “try to make personal attacks on [her] character by insinuating she had ‘issues with alcohol and prescription drug abuse.”

She says that “allowing Plaintiff to introduce evidence of alleged past drug or alcohol use would also improperly invade Defendant’s privacy rights.”

A trial date has been set for April 30.

Mischa Barton and her boyfriend, Adam Spaw, crashed a rental U-Haul truck into an apartment building on February 11, 2017.

As The Blast first reported, U-Haul sued the pair and claimed they still owe them for the truck rental and the storage of their stuff — $5,827.65 — and won’t release the goods until they are paid.
