Mike Comrie, the former professional hockey player who was once married to Hilary Duff, is under investigation for sexual battery, a Los Angeles Police Department spokesperson confirmed to PEOPLE.

The spokesperson could not confirm further details, citing the confidentiality surrounding such cases. According to California law, sexual battery involves a person touching “an intimate part of another person” without their consent.

Calls to representatives for Comrie were not returned.

The Canadian native spent 13 years as a professional hockey centre before hanging up his skates in 2012 following his third hip surgery. His father is the founder of The Brick, one of Canada’s largest retailers.

Duff and Comrie finalized their divorce in January of last year, after splitting almost two years earlier. The pair agreed to co-parent their now 4-year-old son Luca, sharing joint physical custody and adhering to a “mutually-agreed upon” schedule.

According to divorce documents, the pair signed a prenuptial agreement prior to their August 2010 wedding, and had been separated since the start of 2014. Duff, 29, filed for divorce a little over a year later in February 2015.

Duff opened up to PEOPLE about life after Comrie in April 2015, just months after filing divorce papers.

“I went through my highs and lows,” said Duff. “But at the end of the day, I wouldn’t change anything. I feel happy. And I’m excited about everything I have.”
