Law Professor Says Language In Florida ‘Parental Rights In Education’ Law Is ‘Vague’ And ‘Amorphous’

Florida House Bill 1557, the “Parental Rights in Education” bill, was signed into law by Governor Ron DeSantis in March 2022. The law requires that public school districts in Florida be transparent in the selection of instructional, library, and reading materials and prohibits discussion of sexuality or gender identity in kindergarten through grade three. In older grades, the law prohibits instruction that is not "age-appropriate or developmentally appropriate" for students per state standards. Dr. Jody David Armour, professor at the Roy P. Crocker School of Law at the University of Southern California, says that as a legal standard, the language in the Florida law regarding age and developmental appropriateness is both “vague” and “amorphous.” “If you don’t know if you’re going to run afoul of them, you just avoid those conversations altogether,” says Armour.
