Kylie Jenner Has Legal Issue With Rise And Shine, Single Mom From NJ Says She Owns Trademark
Kylie Jenner is going to have a huge legal issue with her newfound success of 'Rise and Shine,' because a businesswoman and single mother in New Jersey already owns a trademark for the catchphrase.
A video of Kylie went viral after she belted out the catchphrase ‘Rise and Shine’ to her sleeping daughter, Stormi. In the aftermath, the hashtag #riseandshine became the fastest ever to hit a billion views on the TikTok.
Kylie capitalized on the phrase by launching two “rise and shine” hoodies on her website that sold out almost instantly.

The Single Mom, And Her Trademark
But, a New Jersey businesswoman and single mom, Cathy Beggan has now come forward, saying she is the rightful owner of a trademark for the catchphrase.
Beggan's issue, she tells us, is that Kylie is already using the phrase, "without the legal license or permission to do so and without any offer of compensation."
“I’ve spent years developing this product line and the Rise-N-Shinebrand,” Beggan says.
Already Have It....
Cathy Beggan is the founder and president of Rise-N-Shine, LLC, a nutritional supplement, vitamin, and cosmetics company she established in 2006. The companies first product, 'Wake Up on Time', is a delayed-release energy supplement.
The company now produces a full line of supplements, and its products include a specialty line of cosmetics such as shampoos and conditioners.
Ready To Fight
“Jenner is seeking a trademark that will cover, among other items, clothing and cosmetics that carry the “Rise and Shine” phrase or similar phrases. Our company already produces cosmetic products as well as clothing items bearing the Rise-N-Shine™ phrase, meaning that her trademark filing infringes on our rights,” Beggan explained.
The big issue for Kylie, Beggan is willing to fight for the trademark, “We have never sought to frivolously enforce our trademark - in fact, this will be the first time we have ever attempted to enforce it - but I have to defend my and my company’s rights in this case,” Beggan said.
Just Make Us a Jingle!
Here's the good news, Cathy has already figured out a way the two women can support each other in business instead of battling it out in court.“If Kylie is willing to sing a jingle for my company, we will consider licensing the phrase to her for use with certain non-competing products, in exchange for a reasonable licensing fee," Beggan tells us.
