Kim Zolciak and Kroy Biermann Ordered to Mediation to Work Out 'Unresolved Issues' in Divorce Case

'The Real Housewives of Atlanta' alum and the retired athlete first filed for divorce in May

The divorce between Kim Zolciak Biermann and her on-again, off-again husband Kroy Biermann is moving forward.

On Monday, The Real Housewives of Atlanta alum, 45, and the retired NFL player, 48, were ordered by Fulton County Superior Court Judge Shermela J. Williams to complete mediation to come to a settlement in their divorce by January 31, 2024, according to a court order obtained by TMZ and Us Weekly.

“As there are numerous unresolved issues, based upon review of the record and applicable authority, the Court finds that the Parties’ interests and the orderly management of the Court’s docket would be served by referring the above-styled case to mediation,” the order reportedly stated. “Both Parties must attend the mediation session.”

The pair can complete mediation through the Fulton County Alternative Dispute Resolution program or hire a private mediator, according to the order. The cost of mediation will be divided equally between the parties.

If they are unable to come to a resolution, the case will remain assigned to the court.

PEOPLE has reached out to the Fulton County Superior Court, as well as a rep for Zolciak Biermann.

Biermann first filed for divorce from Zolciak Biermann in May, though they reconciled and dropped the filing in July. Biermann filed again in August. The athlete also requested sole permission to sell the couple’s Georgia home amid possible foreclosure. A source told PEOPLE the then-exes were living under the same roof, but in the midst of a “money war.”

In mid-September, Zolciak Biermann denounced conversation surrounding the divorce by telling her Instagram followers she and Biermann were “working on our marriage and have been living together as husband and wife.”

Zolciak Biermann requested to dismiss Biermann’s second divorce filing later in the month, stating they "have engaged in marital sexual relations on multiple occasions since [his] filing of the petition for divorce.”

The following month, the pair listed their Georgia home for $6 million.

In mid-November, Zolciak reverted back to her married name on Instagram. The reality star changed her handle to @kimzbiermann — and yes, someone else has already snatched up her old handle, @kimzolciak.

Later that month, the reality star shared a clip of herself singing along to Jelly Roll’s “Save Me” while appearing to be riding shotgun in Biermann’s car on her Instagram Story.
