Kim Zolciak and Kroy Biermann’s Home Is In Danger of Foreclosure Again

Kim Zolciak and Kroy Biermann may have more legal troubles headed their way.

According to new legal documents obtained by PEOPLE, lawyers for the pair’s bank lender, Truist, are giving them until May 3 to go back to court. If not, they could be served with a foreclosure, according to the documents, which were filed on April 23.

This doesn’t mean they have to be out of their house soon, but the legal side will ramp up again for Zolciak and Biermann if they fail to act.

The ex-couple currently have the Atlanta mansion up for sale. In January, amid their messy divorce, they significantly reduced the asking price for the second time after it had failed to sell since October.

The Real Housewives of Atlanta alum and her retired NFL player husband first listed the property in October for $6 million. According to Zillow, they reduced it to $5.5 million in mid-December, and have now given the price an even bigger chop. Records show they lowered it to $4.5 million, 75 percent of what they originally wanted months ago.

The impressive stone mansion is currently listed by Jenny Doyle of Atlanta Fine Homes Sotheby's International Realty. It sits on 1.78 acres in the town of Milton, Georgia, about 40 minutes north of Atlanta. It features seven bedrooms and 11 bathrooms situated in 15,694 sq. ft. of living space.

This isn’t the first time the home has been teetering toward foreclosure. In February 2023, the Real Housewives of Atlanta alum and the former NFL player’s home was placed in foreclosure.

A notice shared by Fulton County at the time stated that the couple had defaulted on $1.65 million loan they took out on the property. Truist Bank planned to auction off the property on March 7, 2023, in front of the Fulton County Courthouse.

However, a source close to the Bravo star confirmed to PEOPLE that the issue has was resolved, stating at the time, "The couple has taken the action to clear this up."

The law office of Brock & Scott, PLLC confirmed to Entertainment Tonight in February 2023 that the auction was canceled on Feb. 22, but could not provide any additional information about the reason for the cancellation.

Since news of last year’s foreclosure notice broke, Zolciak insisted that the situation was a "misunderstanding" with the bank, a source previously told PEOPLE.

"She is telling everyone this is a misunderstanding and is being sorted out," the source said, adding, "She's not moving."
