Kate Bosworth is making it clear, that she will not pay any spousal support in her divorce due to the couple's prenuptial agreement.

According to legal documents, obtained by The Blast, the 'Blue Crush' star is asking a judge to deny any spousal support to her ex-husband Michael Polish.

In the filing, Bosworth says the couple split on June 1, 2021 -- over a year prior to her actually filing the legal divorce. Plus, she says "There are additional separate property assets and obligations of each party as mandated by the parties' Prenuptial Agreement."

Interestingly, Kate makes it clear that during the entire eight-year marriage NONE of the assets were considered "community property." In other words, what's hers is hers and what's his is his. Of course, he is a successful movie producer, so we are guessing there is plenty of money to go around. She wrote, "pursuant to the parties' Prenuptial Agreement, all assets and obligations of each party are her/his separate property. There are no community assets."

Bosworth filed the legal documents under "pro per" -- which means without a lawyer. But, the documents say even if either one of them uses a lawyer for the split, they will pay their own costs.

As The Blast previously reported, Kate filed for divorce from her husband on July 15th, 2022. She officially filed the paperwork to dissolve their marriage with the Los Angeles Country Courts. The couple had been married for eight years.

Bosworth cited “irreconcilable differences” as the reason for the split. This didn’t really come as a surprise to the public, since the pair announced their separation almost a year ago publicly on social media. Last week Kate took to social media once again to formally address the news of the divorce, saying, “The beginning is often the best part of love. Fireworks, magnets, rebellion — the attraction. The onset signals a wide-open expanse of possibility. Split a burger with someone when you are falling in love, and you can die happily knowing this is your last meal. Buy a bottle of whiskey and share shots, pour me a waterfall. Play that perfect song on the jukebox and dance with someone you have known your whole life, though you met minutes ago.”

She very maturely continued, “Inherently we fear an ending, to lose what you have because you got what you wanted. To be attached to the expectation of the outcome. The great Unknown. What if we chose not to fear but instead, to love. If that most delicate and vulnerable last flicker to the flame became another type of furnace entirely. Perhaps this will sound strange to some, romantic to others. To us: this is truth.”

Michael Polish has yet to issue any type of public response to the news of their marriage ending. The couple did not have any children together but Kate was a stepmother to Michael’s daughter from a previous marriage.
