Chicago police are investigating a tip that Jussie Smollett was seen with the two Nigerian brothers on the night they allegedly attacked him, reportedly at the direction of the “Empire” star.

A spokesperson for the Chicago Police Department says that police received a tip from someone who either lives in Smollett’s building or is staying there. The person says they saw Smollett in an elevator with Olabinjo Osundairo and Abimbola Osundairo on the same night as the alleged attack.

According to local reports, Smollett came up with the plan to have two men attack him after a threatening letter he received a week earlier failed to get a bigger reaction.

The Osundairo brothers gave a statement on Monday, saying, “We are not racist. We are not homophobic and we are not anti-Trump. We were born and raised in Chicago and are American citizens.”

Nicknamed Ola and Abel, the two brothers have also retained an attorney, who has that the two brothers know Smollett from work on “Empire,” and worked out with him at their gym.

In a statement released on Monday morning, Smollett’s rep, Anne Kavanagh said, “There are no plans for Jussie Smollett to meet with Chicago police today. Any news reports suggesting otherwise are inaccurate. Smollett’s attorneys will keep an active dialogue going with Chicago police on his behalf. We have no further comment today.”
