Kansas prosecutors dropped three felony charges for aggravated sexual battery against Jackson Mahomes, the younger brother of NFL star Patrick Mahomes, while he still faces a fourth pending charge for misdemeanor battery.

Jackson, 23, was arrested last May after he was seen on a local restaurant’s security cameras allegedly shoving an employee before grabbing the owner by the neck and forcibly kissing her three times.

The incident took place at Aspens Restaurant and Lounge in Overland Park, Kansas last February.

The restaurant has since closed in part because of negative publicity stemming from Jackson’s case, owner Aspen Vaughn told The Kansas City Star last year. Vaughn, 41, also told the newspaper that she’s received death threats and that the restaurant was vandalized since Jackson was charged with felony sexual battery last year.

The Associated Press reported that prosecutors decided to drop the sexual battery charges against Jackson in a court hearing he appeared at Wednesday, however, because Vaughn refused to testify against him.

A spokesperson for the Johnson County District Attorney’s Office told PEOPLE it would not comment on the case, citing the pending fourth charge and a gag order issued by the judge.

Jackson’s attorney Brandon Davies told PEOPLE in a statement that his client "has done nothing wrong."

“We had full confidence that the truth of the matter would ultimately be revealed,” Davies added.

Vaughn told the Kansas City Star in an interview recounting the incident last year that Jackson was friends with her stepdaughter, who was a restaurant employee. He and five friends showed up at the restaurant and made their way into the basement office, she said.

“He forcibly kissed me out of nowhere,” she told the newspaper.

"And I'm telling him, pushing him off, saying 'What are you doing?' and then he proceeded to do it two more times," Vaughn recalled. "Where the last time I was pushing him off, and I can see on the cameras that somebody was outside the office door, and I was yelling for them to come help because he's big and massive."

TMZ published surveillance video from the alleged incident last year, which appeared to show Jackson repeatedly grabbing Vaughn's neck and kissing her as she looks to push him away. Moments prior, Jackson also allegedly shoved a young male waiter out of the room, the Kansas City Star reported.

The fourth battery charge Jackson still faces stems from him allegedly shoving the waiter multiple times.

Jackson has previously faced condemnation from fans for his behavior at games and on social media.

In 2021, Jackson was criticized for a video that showed him pouring water on a Baltimore Ravens fan after the Ravens defeated the Chiefs. A month later, he received backlash online for filming a TikTok video that appeared to show him dancing on top of an on-field memorial to late Washington football player Sean Taylor.
