Inspectors find roaches in Cordova Mall restaurant; 2 other Pensacola eateries cited for bugs

As the temperatures to continue to rise in Pensacola, restaurant inspections from the Florida Department of Business and Professional Regulation landed a few restaurants in the hot seat in July.

Across Escambia and Santa Rosa counties. there were 135 restaurants that passed their inspections last month, compared to the 20 that didn’t. One was temporarily shut down and two other restaurants received administrative complaints.

Out of those that passed, 53 restaurants passed on the first try without a single violation.

One restaurant forced to temporarily close

3D Eats and Tea Cordova Mall, 5100 N Ninth Ave.

Following a July 13 inspection by the DBPR, 3D Eats’ Cordova Mall location was temporarily closed with four total violations, two of which were considered high priority. These violations included:

  • Basic - Dead roaches on premises. Observed approximately 25 dead roaches: 10 dead roaches on floor next to unused ice machine back kitchen, 15 dead roaches on floor underneath shelf warmer front kitchen.

  • Basic - Floor not cleaned when the least amount of food is exposed. Inside floor drain underneath equipment front kitchen.

  • High Priority - Operating with an expired Division of Hotels and Restaurants license.

  • High Priority - Roach activity present as evidenced by live roaches found. Observed approximately 10 live roaches: six live roaches on floor next to unused ice machine in back kitchen, two live roaches on sticky trap underneath shelf warmer front kitchen and two live roaches on floor right side of slushy machine front kitchen.

3D Eats complied with a follow-up inspection the following day and met inspection standards.

Two restaurants receive administrative complaints

Wendy’s Old-Fashioned Hamburgers, 1706 W. Fairfield Drive

Following a July 20 inspection by the DBPR, Wendy’s received seven violations, two of which were deemed a high priority, and an administrative complaint from the DBPR.

High priority offenses included:

  • High Priority - Employee failed to wash hands before putting on gloves to initiate a task working with food. Employee did not wash hands before engaging in food preparation.

  • High Priority - Live, small flying insects in kitchen, food preparation area, food storage area and/or bar area. Observed approximately 11 live flying insects: five in back kitchen landing on prep table, and six inside the male bathroom.

After a follow-up inspection on July 21, the restaurant still had one high priority violation from the initial inspection regarding flying insects. A follow-up inspection is still required.

Lupita’s Mexican Kitchen, 6890 Pensacola Blvd.

Following a July 19 visit from the DBPR, Lupita’s received five violations, one of which was deemed a high priority, and one administrative complaint.

The high priority offense included:

  • High Priority - Live, small flying insects in kitchen, food preparation area, food storage area and/or bar area. Observed a total of eight live flying insects in establishment: four in dining area and four in kitchen area (not on food/ food contact surfaces). One of the four flying insects landed on a single service item. The operator disposed of the item.

After a follow-up inspection on July 20, zero violations were reported.

What agency inspects restaurants in Florida?

Routine regulation and inspection of restaurants is conducted by the Department of Business and Professional Regulation. The Department of Health is responsible for investigation and control of food-borne illness outbreaks associated with all food establishments.

What does all that terminology in Florida restaurant inspections mean?

Basic violations are those considered against best practices.

A warning is issued after an inspector documents violations that must be corrected by a certain date or within a specified number of days from receipt of the inspection report.

An administrative complaint is a form of legal action taken by the division. Insufficient compliance after a warning, a pattern of repeat violations or existence of serious conditions that warrant immediate action may result in the division initiating an administrative complaint against the establishment. Says the division website: "Correcting the violations is important, but penalties may still result from violations corrected after the warning time was over."

An emergency order — when a restaurant is closed by the inspector — is based on an immediate threat to the public. Here, the Division of Hotels and Restaurants director has determined that the establishment must stop doing business and any division license is suspended to protect health, safety or welfare of the public.

A 24-hour call-back inspection will be performed after an emergency closure or suspension of license.
