Indiana Boy Is Fatally Shot a Week After Celebrating 12th Birthday, 2 Suspects Charged

Nagomba White, Jr., 21, and Amarion Cutler, 18, face multiple charges in connection with the Oct. 27 shooting death of 12-year-old Josiah Small

Two Indiana men face murder charges in connection with a shooting last month that killed a 12-year-old boy and injured a 14-year-old in South Bend, authorities said.

Nagomba White, Jr., 21, was arrested Nov. 9 in Indianapolis on charges that include murder, conspiracy to commit murder, attempted murder, and attempted battery by means of a deadly weapon, according to a statement from the South Bend Police Department. He is currently being held at the St. Joseph County Jail and is expected in court on Nov. 29.

Amarion Cutler, 18, has been charged with aiding, inducing or causing murder, conspiracy to commit murder, two counts of attempted murder, attempted battery by means of a deadly weapon, and battery by means of a deadly weapon. Cutler is still at large and should be considered “armed and dangerous,” police said, adding that anyone who sees him should call 911 immediately.

It’s unclear if the suspects have retained attorneys.

The 12-year-old boy, who has since been identified by police and family as Josiah Small, was found suffering from gunshot wounds at a location in South Bend where officers responded to a report of a shooting on Oct. 27. Josiah was pronounced dead at the scene, police said.

Also at the scene was a wounded 14-year-old who was taken to a hospital for treatment. Police have not identified the teen but said he's expected to survive.

By Nov. 6, authorities had identified and charged the two suspects, whose warrants were “sealed to allow law enforcement to apprehend them,” the statement reads.

At a press conference on Monday, St. Joseph County Prosecutor Ken Cotter said a group of four children, including the two victims, were walking along a sidewalk when at some point they separated. Two of the boys then had a brief confrontation with two people in a car, who were later identified as White and Cutler.

As the boys walked away, the car then reportedly turned around and chased after them. Cotter said both suspects got out of the vehicle and fired shots at the four boys, with two of them being hit. The prosecutor added that surveillance video of the incident helped investigators identify the suspects.

“When a 12-year-old gets killed in our community, I think that is something we need to be able to take seriously, and to let folks in our community know that the South Bend Police Department has taken this incredibly seriously,” Cotter said.

According to his obituary, Josiah was killed just one week after celebrating his 12th birthday. He was remembered as someone who enjoyed watching anime, wrestling and spending time with his baby sister.

A GoFundMe campaign launched by Josiah’s family shortly after his death states that he was a 6th grade student at Dickerson Middle School, where he played football.

“[He was] a very respectful kid, [who] had his whole life ahead of him,” a loved one wrote on the fundraising page, which hoped to use the donations to cover funeral expenses.

Josiah is survived by his parents, sister, four brothers and other family members, according to his obituary.
