Harvey Weinstein Sued by Actress Who Claims He Raped Her

An actress filed a lawsuit Tuesday in which she alleges that Harvey Weinstein raped her at the Montage Hotel in Beverly Hills, Calif., last year.

The actress, identified in the suit only as Jane Doe, claims that Weinstein also masturbated in front of her without her consent during an earlier meeting at the same hotel. She said Weinstein wanted to meet with her to discuss a role in the Netflix series “Marco Polo.”

The plaintiff, represented by attorney Gloria Allred, filed suit against both Weinstein and the Weinstein Co. The suit alleges that the company was aware of multiple sexual misconduct claims against Weinstein, and cites reports that Weinstein’s 2015 contract included provisions to “cure” harassment incidents by payment of damages to the company.

Weinstein’s representatives denied the allegations.

“Any allegations of non-consensual sex are unequivocally denied by Mr. Weinstein,” a spokesperson said. “Mr. Weinstein has further confirmed that there were never any acts of retaliation against any women for refusing his advances. Mr. Weinstein obviously can’t speak to anonymous allegations, but with respect to any women who have made allegations on the record, Mr. Weinstein believes that all of these relationships were consensual.”

According to the suit, the actress met Weinstein in 2011 at a party at the Chateau Marmont. Weinstein offered to help her with her career and got her phone number. Over the next few years, he invited her to several events, the lawsuit states.

In late 2015, the lawsuit alleges that Weinstein met her at the Montage Hotel to discuss casting her in “Marco Polo,” which was produced by the Weinstein Co. According to the suit, during the meeting Weinstein announced that he wanted to masturbate in front of her. She said she did not want him to do that.

“Weinstein told her that he would not touch her, but ‘only’ wanted her to watch him,” the suit states. “Despite her telling Weinstein ‘no,’ Weinstein proceeded to grip her wrist with one hand while using the other to masturbate in front of her to completion.”

In the spring of 2016, the suit states that Weinstein contacted her and gave her the impression that she had been cast in “Marco Polo.” He invited her to meet him again at the Montage Hotel to celebrate. She agreed, according to her suit.

During their meeting, the suit states that Weinstein excused himself and returned in a bathrobe. She said she did not want to do anything sexual, but she alleges that he dragged her into the bedroom and threw her on the bed. She claims that he then pulled down her jeans and began to orally copulate her against her will. The suit states that Weinstein “used his massive weight and strength to force himself on her,” and raped her. He then pulled out and held her down while masturbating with the other hand, according to the lawsuit.

As soon as she could break free, she says she fled the room. Weinstein later called her as if nothing had happened and told her he would be coming to Los Angeles, the suit states. She swore at him and hung up.

She never received the part in “Marco Polo.”

The lawsuit states claims of sexual battery, assault, and negligence, and seeks compensatory and punitive damages.
