In August, Musso, 32, was arrested in Texas on charges of public intoxication and theft. A press release obtained by PEOPLE at the time stated that there was a 911 call for a disturbance at a Rockwall hotel.

“Upon arrival, officers contacted the complainant who advised an individual who appeared intoxicated entered the hotel, selected a bag of chips and began eating them,” the release said. “When the subject was asked to pay for them, he became verbally abusive and left without rendering payment.”

The actor, known for the role of Oliver Oken on the Disney Channel series, spent one night in jail and was released on a $1,000 bond. Musso also had additional outstanding warrants due to a failure to display a drivers license and an expired registration, according to Fox News, adding that the actor violated a “promise to appear” order.

Speaking with PEOPLE, Musso denied the August incident. “There was no theft, and I was not intoxicated," he said. "It's just been unfortunate, but it's a big misunderstanding."

He recounted the incident in a different light. "This disgruntled employee, whose behavior was erratic, ripped the bag of potato chips out of my hand and started yelling at me about my attire," said Musso, who said he offered to pay for the chips. "He said, 'Get out or I'm going to call the police.' Ultimately, I said, 'Sure. Call the cops.'"
