Halyna Hutchins' Mother Visits Late Cinematographer's Grave 2 Years After “Rust” Shooting

New Mexico special prosecutors expect to present a new criminal case to a Santa Fe grand jury against Alec Baldwin over Hutchins' death in the next two months

Halyna Hutchins' mother is marking the second anniversary of the late cinematographer's on-set death at 42.

On Saturday, Hutchins' mother Olga visited Hollywood Forever Cemetery in Los Angeles to see her daughter's gravesite, accompanied by her family's attorney Gloria Allred. Video of Olga's visit shared by ABC 13 shows her and Allred carrying flowers to the grave, as well as Olga crying as she viewed the grave itself.

Hutchins was working as the cinematographer on Alec Baldwin's Western film Rust when she was shot and killed after a prop gun held by Baldwin, which turned out to contain live rounds, was discharged while filming in New Mexico in October 2021.

The Hutchins family is engaged in a civil lawsuit against Baldwin, 65, as a criminal investigation into the actor-producer's role in the incident remains underway. The armorer on Rust, Hannah Gutierrez-Reed, was charged with involuntary manslaughter in January and is expected to stand trial in February.

"There's a family here that is hurting, that is in pain, that is suffering," Allred told reporters, per ABC 13. "There was a real human being here who was shot to death that day, and we're always going to remember Halyna."

Baldwin was also charged with involuntary manslaughter along with Gutierrez-Reed in January, but New Mexico special prosecutors Kari Morrissey and Jason Lewis dismissed that charge in April, citing “new facts” in the case. Morrissey and Lewis said at the time they reserved the right to re-charge Baldwin; last Tuesday, they announced they intend to present their case to a Santa Fe grand jury within the next two months.

“After extensive investigation over the past several months, additional facts have come to light that we believe show Mr. Baldwin has criminal culpability in the death of Halyna Hutchins and the shooting of Joel Souza,” the special prosecutors said in a statement.

“We believe the appropriate course of action is to permit a panel of New Mexico citizens to determine from here whether Mr. Baldwin should be held over for criminal trial.”

Baldwin's attorneys Luke Nikas and Alex Spiro of Quinn Emanuel told PEOPLE: "It is unfortunate that a terrible tragedy has been turned into this misguided prosecution. We will answer any charges in court."

Baldwin and Rust's producers finished filming the movie earlier this year after his involuntary manslaughter charge was dropped and after they settled a wrongful death lawsuit filed by the cinematographer's widower, Matthew Hutchins, in Oct. 2022.

The group completed the movie with Matthew on board as an executive producer, along with Academy Award-nominated producer Grant Hill (The Thin Red Line) and cinematographer Bianca Cline (Marcel the Shell with Shoes On) working in Hutchins' place.

Baldwin's attorneys previously requested a judge dismiss Hutchins' family's lawsuit against the actor in April.

"The loss of a daughter and sister is undoubtedly painful in any circumstance," lawyers for Baldwin wrote in court documents, dated to Thursday, April 13, and obtained by PEOPLE. "Yet Plaintiffs — who had been distanced from Halyna physically, financially and emotionally for years before her death — have no viable cause of action against Defendants. This action is especially misguided."

At the time, Allred said in a statement obtained by PEOPLE that "it is abundantly clear under New Mexico law, which will be applied in the California court, that [Baldwin] is responsible for all of the harm he did to the entirety of Halyna Hutchins' family."
