Duane “Keefe D” Davis, the man charged in the 1996 murder of rapper Tupac Shakur, is seeking a release pending trial, citing health issues and a lack of concrete evidence connecting him to Shakur’s death.

According to 8 News Now, attorneys for Davis filed a motion requesting that their client be released on his own recognizance under the condition that he’ll be under electronic monitoring via an ankle bracelet. The suspect’s legal team also claims that Davis is “not a threat to the community,” nor “a flight risk” and have asked that he receives bail not exceeding $100,000.

According to the filing, prosecutors “did not introduce any independent evidence connecting Duane Davis to the shooting” and merely used statements from Davis himself in his book, Compton Street Legend, as well as various interviews.

Davis’ lawyers claim that their client’s claims in his book and interviews were for “entertainment purposes” and that the other evidence against him is based on “an astounding amount of hearsay.” They also argue that the books and interviews conducted were for Davis’ “financial benefit” and due to him believing he had immunity. Davis has plead not guilty to one count of murder with a deadly weapon.

“The truthfulness of the content of the interviews was never verified,” Davis’ attorney claimed, likening his client’s actions to that of Greg Kading. Kading, a former Los Angeles Police Department detective who investigated the deaths of Shakur and The Notorious B.I.G., released books and conducted interviews with many of the same outlets as Davis and also received compensation. “The book and interviews were done for entertainment purposes and to make money from a situation that Kading and others had already profited.”

A court hearing regarding Davis’ request for release is scheduled for January 2.
