Diddy Requests To Dismiss Gang-Rape Lawsuit Involving A Minor

Sean “Diddy” Combs’ legal team has filed a motion requesting a New York judge to dismiss one of his sexual assault-related lawsuits.
The case involves Combs, Harve Pierre, and an unnamed third assailant who allegedly raped a 17-year-old Jane Doe in a New York recording studio back in 2003. Jonathan D. Davis, the attorney representing Sean Combs, Daddy’s House Recordings, Inc., and Bad Boy Entertainment Holdings, Inc., filed the request on Friday (May 10), claiming the lawsuit was a “false and hideous claim” that was untimely filed.
“This stunt is intended to prominently showcase a baseless and time-barred claim, which was designed to cause the Combs Defendants unwanted publicity, embarrassment, and financial costs, so Plaintiff could extract an undeserved financial recovery from them,” the motion read.
It continued, “Mr. Combs and his companies categorically deny Plaintiff’s decades-old tale against them, which has already caused incalculable damage to the reputations and business standing of the Combs Defendants, even before any evidence has been presented. Plaintiff cannot allege what day or time of year the alleged incident occurred, yet purports to miraculously recall the most prurient details with specificity. This case should be dismissed now, with prejudice, to protect the Combs Defendants from further reputational injury and before more party and judicial resources are squandered.”
The request also claimed that the lawsuit “is time-barred because the ‘claim-revival’ provision of the [New York City’s] Victims of Gender-Motivated Violence Protection Law (VGM) is preempted by the [New York State] Adult Survivors Act and Child Victims Act.” Though the law allows accusers to file civil complaints beyond the statute of limitations, Combs’ legal team said her suit needed to be filed by August 2021. “New York state law trumps New York City law, without exception,” the filing read.
The judge has already denied the motion for Jane Doe to remain anonymous in this case and should Combs’ request be denied, the alleged victim’s name will be publicized.
She claimed that she met Pierre while in high school in Detroit and he flew her to New York on a private jet, where she was given drugs and alcohol to the point where she was unable to consent to sex. The initial lawsuit stated that she was unaware she was being gang-raped.
This was one of several lawsuits that came after Cassie’s lawsuit surfaced last November. It was swiftly settled, but after getting hit with over the weeks that followed, Diddy finally issued a statement on the matter. “ENOUGH IS ENOUGH. For the last couple of weeks, I have sat silently and watched people try to assassinate my character, destroy my reputation and my legacy. Sickening allegations have been made against me by individuals looking for a quick payday. Let me be absolutely clear: I did not do any of the awful things being alleged. I will fight for my name, my family and for the truth,” said the Bad Boy Records founder.
Last month, Combs filed a separate motion to dismiss a suit filed by Joi Dickerson, who claimed she was also drugged and sexually assaulted by Combs when she was 19.
