Dean McDermott Pushes Back Against Tori Spelling's Divorce Filing as He Disputes Separation Date and Child Custody

More than six weeks after Tori Spelling filed for divorce, Dean McDermott has filed a response, shedding some new light on the couple's proceedings.

On May 13, the actor, 57, filed a response to Spelling's March 29 divorce filing, as he similarly requested the dissolution of their marriage due to irreconcilable differences, but listed a different separation date than his wife had.

In the Beverly Hills, 90210 star's filing, she listed June 17, 2023 as the couple's date of separation — the same day McDermott announced that they had decided to go their separate ways in an Instagram post that he later deleted. In his response, McDermott listed July 7, 2023 as the date of separation.

McDermott's filing also pushes back against Spelling's request for sole physical custody of their five kids — Liam, 17, Stella, 15, Hattie, 12, Finn, 11, and Beau, 7 — as he requested joint physical and legal custody instead.

The Canadian actor requested spousal support for himself, and the termination of spousal support for Spelling, 50. In her filing, she requested the court to award her spousal support and terminate McDermott's ability to receive the same.

In the weeks since she filed for divorce, both Spelling and McDermott have spoken out about the demise of their relationship and the reasons behind their divorce, which she said on an episode of her podcast, misSPELLING, was "15 years" in the making.

"We always say, 'Hey, it made it 18 years. It shouldn't have made it 18 years.' And I think he would say the same thing if he and I had a real heart-to-heart. It would have been over a lot sooner," Spelling admitted.

She said she's "never felt more alone," and doesn't "feel worth loving," as she revealed that the couple had a "very quick, passionate falling in love period" but there were "red flags" early on. "I like saying that I just like to make dresses out of red flags and then proceed."

Starting their family — which happened pretty soon after they met and married — also changed the pair's relationship, as Spelling said, "Honestly, our relationship was never the same after we started having kids."

Days after she filed, McDermott said he was doing "good" in a video obtained by the Daily Mail. "It's been a long time coming but T and I are good," he said.

He has since begun a relationship with Lily Calo, who he was first photographed with in October. Spelling has said that she spends time with her ex and his new girlfriend at family dinners.

"I like Lily a lot. It's not bad. It's just, you know, it's different," she said on an episode of her podcast in April.
