Danny Masterson Failed to Turn Over Nine Firearms, Leaving Jane Does ‘Scared’

Convicted rapist Danny Masterson failed to turn over nine of 23 guns after his felony arrest three years ago – and two of the Jane Does whose allegations led to his criminal charges tell Rolling Stone they’re “scared” and want answers.

The Jane Does attended a court hearing in Los Angeles on Monday, where Judge Charlaine Olmedo gave Masterson’s camp until December 7 to provide proof the weapons have been found and secured. If Masterson’s lawyers fail, Judge Olmedo said she’ll order a search and seizure.

One of the Jane Does says she’s particularly upset because some of the missing weapons registered to the disgraced That ’70s Show actor are semi-automatic rifles. “I’m really upset and scared. We’re very upset those guns are missing,” she told Rolling Stone after the hearing, months after testifying at trial that Masterson pulled a gun out of his nightstand the night he raped her in 2003.

“He has a lot of people who will support him,” she said, her eyes filling with tears. “It’s scary. I don’t understand how there’s no oversight. …I guess it was just Scout’s Honor?”

The other Jane Doe at Monday’s hearing also testified at the trial, but the jury couldn’t reach a unanimous verdict on her alleged assault. She remains one of the plaintiffs suing Masterson and the Church of Scientology for alleged stalking and harassment linked to the sex assault allegations. “These guns were never turned over and we have unhinged, crazy people who want us destroyed. I don’t understand,” she tells Rolling Stone. “I get death threats daily.”

During the hearing, Judge Olmedo asked Masterson’s lawyer what happened with the guns listed as outstanding on his most recent probation report. “I can represent that they’re not in his possession, custody or control and have not been since prior to the 2020 order, but we are continuing to investigate and confirm as to the location and status of those firearms,” defense lawyer Kate Mangels said.

“I’m not sure if I’m hearing you correctly, Ms. Mangels, if Mr. Masterson doesn’t even know where these guns are located at this point?” Judge Olmedo asked. Mangles didn’t immediately reply, and the judge continued with her ruling. “We need to resolve this one way or the other,” the judge said, ordering Masterson’s side to legally secure or surrender all outstanding firearms to local law enforcement by Dec. 7 or face the search warrant.

Last September, Judge Olmdeo sentenced Masterson to 30 years to life in prison for raping two women during his sitcom heyday in 2003. “When you raped me, you stole from me. That’s what rape is, a theft of the spirit,” a third Jane Doe raped in 2003 who did not attend Monday’s hearing said in her victim impact statement at the sentencing. “You are pathetic, disturbed, and completely violent. The world is better off with you in prison.”

A jury convicted Masterson in May after a prior trial on the same charges ended with a deadlock. Both trials included emotional testimony from the three women whose allegations led to the charges. All three women said Masterson drugged them before raping them. They were practicing Scientologists at the time and testified that Church of Scientology officials protected Masterson.

Masterson, 47, was taken into custody in May and has been locked up in Los Angeles County jail. He did not attend Monday’s hearing.

Before Masterson was sentenced, actors Ashton Kutcher and Mila Kunis, who also starred on That ’70s Show, wrote letters to the court complimenting his character. They later issued a public apology.
