Danny Masterson Is Denied Bail as Judge Declares He Has 'Every Incentive to Flee': Report

The 'That '70s Show' alum was sentenced to 30 years to life in prison after he was found guilty on two counts of rape in May 2023

Danny Masterson has been denied bail pending appeal due to fears the actor would run.

On Wednesday, Los Angeles Superior Court Judge Charlaine Olmedo said the That '70s Show alum, 47, will "likely remain in custody for decades, and perhaps the rest of his life" if the
"defendant's conviction and sentence are upheld on appeal" in an order obtained by Deadline.

Per the order, Olmedo cited Masterson's ongoing divorce from his wife Bijou Phillips as a factor in the court's decision.

“In light of the fact that defendant has no wife to go home to, defendant now has every incentive to flee and little reason to return to state prison to serve out the remainder of his lengthy sentence should his appeal be unsuccessful,” Olmedo continued.

PEOPLE has reached out to Masterson's new lawyers, Clifford Gardner and Eric Multhaup, for comment.

Olmedo's move to deny the actor bail comes after a hearing this morning at the Downtown Los Angeles Clara Shortridge Foltz Criminal Justice Center for Masterson's potential appeal.

According to Deadline, Masterson's new lawyers Clifford Gardner and Eric Multhaup filed a motion on Jan 17. requesting that "this Court rant bail on appeal, and offers to comply with any relevant terms and conditions imposed by the Court that enable him to be an at-home parent and financial provider for his family, including house arrest and/or participation in an electronic monitoring program administered by the probation department."

In May 2023, Masterson was found guilty on two counts of rape after he was charged in 2020 with forcibly raping three women in separate incidents between 2001 and 2003, per the Los Angeles Times. After jurors deliberated for more than seven days, a third count of rape resulted in a hung jury.

Upon receiving his verdict, L.A. reporter Meghann Cuniff reported that The Ranch actor did not register much of a reaction, though his family members were "fighting back tears" and Phillips began to cry.

Cuniff claimed Olmedo told Phillips, "Can you maintain your composure? I know it's hard. But if not I need you to step outside." Masterson was then handcuffed and immediately sent to jail.

Several months after his conviction in September, Masterson was sentenced to 30 years to life in prison for his crimes. In a court sketch, the actor was seen blowing a kiss to Phillips before being led away to his cell, per Variety.

Phillips filed for divorce from the actor later that month, citing "irreconcilable differences" as the reason for their split after nearly 12 years of marriage.

"Ms. Phillips has decided to file for divorce from her husband during this unfortunate time. Her priority remains with her daughter," Phillips' lawyer Peter A. Lauzon told PEOPLE in a statement.

He continued, "This period has been unimaginably hard on the marriage and the family. Mr. Masterson was always present for Ms. Phillips during her most difficult times of her life. Ms. Phillips acknowledges that Mr. Masterson is a wonderful father to their daughter. She hopes that everyone will respect her family's privacy in these difficult times."
