‘Broken City’ Fraud & Breach Of Contract Suit Settled
The producers of the 2013 film Broken City have settled a $6.2 million fraud and breach of contract suit brought by the film’s investor Nemesis Finance. The Allen Hughes-directed film stars Mark Wahlberg, Russell Crowe and Catherine Zeta-Jones, who were not party to the dispute.
Filed in June, the suit claimed Nemesis faced losing $1.6 million after producers Randall Emmett and George Furla allegedly misrepresented the amount of debt owed to investors so that they could reduce the residuals reserve deposits required by the major guilds.
According to the suit — against Randall Emmett/George Furla Productions, LLC; Georgia Film Fund Seven LLC; George Film Fund Ten, LLC; Randall Emmett individually, and George Furla individually — Broken City‘s producers “irrevocably, absolutely, and unconditionally guaranteed to pay any losses incurred by (Nemesis and Oasis) as a result of any residuals payable to the DGA, SAG, and WGA exceeding the amount of the residual reserve.”
In a joint statement announcing the settlement, the parties said they have “amicably resolved the dispute…and look forward to continuing an ongoing business relationship.”
The producers have apparently met all their residuals requirements. One indication of that is that they are not on the WGA “Strike List” of producers who have failed to pay residuals.
