Anne Heche’s Family Facing Major Legal Fight Over Deadly Car Accident

Anne Heche's estate is dealing with an ongoing legal case concerning the car accident that caused her untimely death.

According to new legal documents, obtained by The Blast, Anne's son -- Homer Laffoon -- is asking the court to appoint him as special administrator of her estate, so he can deal with the issues. In the filing, Homer's lawyer claims the estate needs to defend itself against a claim made for damages from the deadly car accident.

As we reported, Heche was reportedly speeding down a residential street and eventually crashed into a house causing a major fire. At this point, it appears she is at fault.

"Due to a motor vehicle accident that occurred shortly before the death of (Heche), there are pending claims against her that require immediate attention. More specifically, I received correspondence from the law firm representing the subrogation claimant informing the representative of (Heche) that a destructive scene and evidence examination of the subject property would take place on September 16, 2022, and that this was the Estate’s opportunity to inspect the scene and remaining evidence, including any liability insurance carriers for her and expert investigators," the filing reads.

Adding, "On behalf of (Homer), I contacted the attorney handling the claim and was able to arrange for the examination to be postponed to give him adequate time to secure the appointment of a personal representative."

The legal documents don't specify if the legal case is just involving insurance, or if anyone is suing the actress for damage caused during the accident and fire.

Interestingly, the filing includes information regarding a new book deal entered into by Anne before her death. It appears the publisher, and the estate is continuing with the project.

"Furthermore, I have been made aware that the Decedent entered into a publishing agreement prior to passing regarding a book she wrote," it says. Adding, "and it is anticipated that the estate will need to monitor and coordinate the interests of the estate as the book is brought to market, including prior to the appointment of an administrator with general powers."

Unfortunately, it looks like the family is having issues too. Homer's attorney discusses issues with Anne's ex-husband -- James Tupper -- who is the father of Anne's minor son Atlas. The filing reveals his big brother claims he is having trouble communicating with him due to Tupper's control of the communication.

"My client has informed me that James is using Atlas’ phone to pressure and attempt to manipulate him (Homer). James has also left voicemails in a similar tone. Homer is anxious to have a free flow of information with Atlas, but James’ style is not productive," he wrote.

Adding, "Additionally, if you have objections to the petition for special administration, please let me know now so they can be addressed now. As you know, Homer is entitled to the appointment he is seeking. He meets all the legal requirements and I am not aware of any grounds for denying him that right."

Anne Heche's Death Ruled An Accident, Toxicology Still Pending

As we reported, Anne Heche died after suffering major injuries from a fiery car accident. The actress succumbed to "thermal injures" to her lungs and major damage due to the traumatic blunt force of the accident.

The estate case is ongoing, a judge will now decide what powers to give to Anne's son.
