CHARLOTTE, N.C. (QUEEN CITY NEWS) — In an interview with People Magazine actress Angie Harmon said she has filed a lawsuit against Instacart and the delivery driver who shot and killed her dog at her Charlotte home.

The deadly incident occurred on March 30 when the driver stated that he was dropping off an order and was allegedly attacked. That driver is not facing any criminal charges. He told police he killed the dog in self-defense. Harmon is looking to get $25,000 in damages.

CMPD confirmed to Queen City News the driver “told officers that a dog attacked him while he was at the residence and that he defended himself by firing a single gunshot, striking and mortally wounding the dog.” Another dog was present at the home but did not attack.

Queen City News Chief Legal Analyst Khalif Rhodes explained that charges typically come out of the belief that the driver had reason to fear for his life.

“If you’re saying this dog is an elderly dog that is limping down the street barely barking, a reasonable person might not think that, but if it’s charging down the street at you barking aggressively, maybe they would,” he explained.
