'90210' Shannen Doherty Ripped By Judge For Playing Dirty Legal Games in Malibu Fire Court Battle

“90210” star Shannen Doherty is being trashed by a judge who says he will not tolerate her behavior in an ongoing legal battle.

According to court documents obtained by The Blast, the actress was scolded in the ongoing battle with her insurance company over damage to her Malibu mansion.

Doherty sued State Farm accusing them of refusing to cover her claims relating to damage done by the Woolsey Fire. The insurance company denies all allegations of wrongdoing. The case is headed to trial in the near future.

State Farm recently accused Doherty of refusing to turn over medical records or allow them to inspect her home. They took issue with her husband and doctor refusing to be deposed. The insurance company asked the judge to step in and order Doherty to comply.The judge came back with his decision and sided with State Farm. He believed Doherty and her lawyers were playing dirty legal games. He wrote, “Such delaying tactics smack of gamesmanship.”

The order states, “The Court is dismayed that plaintiff and her counsel have not worked cooperatively and in good faith to accomplish the task of meeting and conferring with defendant in this action on these very basic deposition and site inspection scheduling issues.”

He added, “Plaintiff, who disclosed her husband and Dr. Piro as witnesses in her initial disclosures, and who is seeking additional compensation from State Farm for damage to her home and property resulting from a fire, should not be surprised that defendant decided to depose these witnesses and inspect that property, and is required to fully participate in the discovery process in this action that she initiated. The Court will not tolerate the gamesmanship engaged in by plaintiff and her counsel with respect to the aforementioned scheduling.”

The judge ordered the inspection of Doherty’s home will be completed by December 20. The depositions of Doherty’s doctor and husband are to be done by next month.

Earlier this year, the actress sued State Farm General Insurance over damage to her Malibu home from the Woolsey Fire.

In the suit, Doherty said, “State Farm will take advantage of the vulnerability and distress of its policy holders when they find themselves in the very situations they paid thousands of dollars in premiums to insure against.”

The “90210” actress said her home suffered severe smoke damage from the fire and was unable to live at the property She claimed State Farm only offered two weeks in a temporary home, while her property was cleaned up, which Doherty believed was absurd.

Doherty said the entire ordeal was “incredibly distressing” especially as she undergoes “invasive cancer treatment, including chemo and radiation therapy. The star was diagnosed with breast cancer in 2015.

Doherty’s lawsuit sought for State Farm to cover all her damages.. State Farm denied the allegations of wrongdoing. They believed they were in the right for denying some of her claims.

State Farm admitted the actress’s home was damaged in the fire and they provided her money for temporary housing. They demanded her entire lawsuit be dismissed

In April, the “90210” actress informed the court she was still stuck in temporary housing. Doherty said she was forced to evacuate her home, “and the premises have remained uninhabitable since November 2018, during which time Plaintiff has been living in temporary housing.”

At the time, State Farm said they paid Doherty a total of $350,015.70 for damage and temporary housing along with furniture rental.

The insurance company said they paid for the replacement of her personal property. State Farm said they covered for Doherty to stay in a $35,000 a month rental home (in addition to the money paid for her and her family to live at the fancy Fairmont Hotel in Santa Monica.)

Earlier this month, the court battle turned nasty with State Farm accusing Doherty of refusing to turn over medical records. They also claimed her doctor and husband refused to be deposed.

State Farm claims, “As of September 11, 2019, State Farm has paid benefits totaling $1,084,948.01 to clean and repair plaintiff’s home and personal property, and for temporary housing and furniture rental. Although State Farm paid for the damage to plaintiff’s home, personal property, and for temporary housing and furniture rental, plaintiff nevertheless alleges she is entitled to additional benefits under her Homeowner’s Policy.”

They also requested a site inspection of her home but have not be given access yet. State Farm claims Doherty has given them the run around and has yet to agree on a date.Further, they claim both Doherty’s husband, Kurt Iswarienko, has refused to sit for a deposition. They wrote, “On November 19, 2019, State Farm asked Iswarienko on four instances whether he would appear at his deposition or whether alternative dates were available. Each inquiry was met with a vague response, and Iswarienko, for the first time, represented that State Farm’s desire to depose him was “harassing”

They also accused Doherty of refusing to produce relevant medical records from her physician Dr. Piro.

State Farm blasted Doherty,” the plaintiff has fed State Farm a variety of false promises and has caused irreparable damage and prejudice. In addition, plaintiff continues to use her medical condition as a sword in this action yet is actively shielding State Farm’s multiple requests for Dr. Piro’s medical records and deposition in order to vet the veracity of her allegations.”

The case is ongoing.
